Lawyers: Burn Your Bar Card for Heat

We have two forms of lawlessness in the Trump Administration

I’ve bolded the LOL part of this piece below. The context is the recent Supremes decision saying that the President can fire members of so-called “independent agencies”:

In another sign of where the majority is leaning, it mentioned, out of the blue, that the Federal Reserve, for some reason, is uniquely protected from the President’s whims due to its “unique structure” and “distinct historical tradition.” Experts have told TPM over the last few months that their only hope for the survival of independent agencies amid this onslaught from the administration is the right-wing justices’ concern about Trump taking over the Federal Reserve, installing loyalists who would send the global economy into a tailspin. But the Court is telegraphing that it will find a way, no matter how legally flimsy, to silo the Fed out of its coming deathblow to independent agencies. 

Legal experts look at upcoming Supreme Court decisions and say “there’s no logically consistent way that the court could do X, which the Republicans want to do, because it would conflict with Y, which is a Republican interest.” The Roberts Court says, “hold my beer” and just makes an illogical carve-out for Y. Also, the thousands of times that we’ve heard Senators talk about stare decisis (adhering to precedent) during confirmation hearings is made a joke by this latest decision, which overturns a precedent honored since 1935.

What’s the point of legal “logic” and precedent with this corrupt political court? Put simply, there’s no point. These fuckers were put into their position to facilitate endless Republican rule, and they know their jobs. Yeah, every so often black-letter law (such as birthright citizenship) will stop them, but in those cases they’ll delay, nibble around the edges, and otherwise obstruct justice as much as they can.

I’ve always been skeptical about people posting on blogs and social media who are constantly dissecting court decisions and spiking the ball when one goes “our way”, for two reasons. First, these wins are ephemeral. They mean nothing until the Supremes rule — or more likely overrule — them. Second, the Trump Administration is just going to ignore and try to weasel out of doing what the courts say. Just ask Kilmar Abrego Garcia, who if the courts had their way should have been back in the USA.

In other words, there are two forms of lawlessness in Trumpism. The first is ignoring the law and ignoring court decisions. The second is a Supreme Court and some Trumpy federal judges who ignore the law to create outcomes that favor Trump. Put together, they make a mockery of our supposed rule of law.
