Can Corruption Be More Blatant?

As the House votes on the deal to reopen the government, here is a key clause snuck into the document by Marsha Balckburn (and others):

“(2) Cause of Action.— Any Senator whose Senate data, or the Senate data of whose Senate office, has been acquired, subpoenaed, searched, accessed, or disclosed in violation of this section may bring a civil action against the United States if the violation was committed by an officer, employee, or agent of the United States or of any Federal department or agency.

(3) Relief.—
(A) In general.—If a Senator prevails on a claim under this subsection, the court shall award—
(i) for each instance of a violation of this section, the greater of statutory damages of $500,000 or the amount of actual damages;
(ii) reasonable attorney’s fees and costs of litigation; and
(iii) such injunctive or declaratory relief as may be appropriate.

(B) Jurisdiction.—The district courts of the United States shall have jurisdiction over civil actions under this subsection.

(C) Waiver of sovereign immunity.—The United States hereby waives sovereign immunity to suit and liability under this subsection.”

So apparently senators must now be notified in advance if their phone records are requested during the investigation of a crime. No one else, just senators. So they're free to crime and can't be investigated without notice. This is so wrong, but it's great for senators who want to commit crimes.

Forget about the fact that these Senators want $500,000 per violation. Forget about the fact that they want “the greater of” $500K or actual damages. These corrupt miscreants actually inserted a law that "waives sovereign immunity. For those who might not know what sovereign immunity is, it means federal and state governments are generally immune from lawsuits—you can’t just take the government to court unless Congress has passed a law saying you can.

This disgusting grift is going to be passed into law. You’d think the Cowardly 8 Dem Senators would at least have ensured something like this was NOT part of their sniveling deal. You want to argue that they got the best deal possible by caving b/c they never were going to get ACA credits renewed (Josh Marshall - again, who I strongly respect and generally agree with - anyone?)? Fine - although I vehemently disagree.

But allowing this clause alone is enough to kick each one of them out of office and into the moon…

This needs to become the face of abject corruption in the Republican Party today and repeated and used against every single Republican Senate and House candidate (because they all voted for it).

We alos need to deal with those Senate Dems in our own way…
